Continuing Legal Education

CLE Courses for Attorneys

Six on-demand programs on medical records, clinical evidence and healthcare litigation — each one approved by The Florida Bar, and the foundation course also approved by the State Bar of California. All taught by Michelle Carroll, Founder and Chief Clinical Strategist, Lexcura Summit.

The course series

Every course is a prerecorded, on-demand audiovisual program you can watch at your own pace. No prior clinical training is required, although familiarity with civil litigation and medical-record review is helpful. Each course lists its Florida Bar course number and approved credit hours.

Course 1

Clinical Intelligence in Medical-Legal Analysis: Beyond Traditional Chronology

1.5 General CLEAlso approved in California

Traditional medical chronologies organize what happened and when. This intermediate attorney education program explains how Clinical Intelligence extends that work by testing the integrity of the evidence, interpreting the patient's baseline, connecting imaging to clinical context, reconstructing meaningful decision windows, evaluating role-specific standards of care, applying a focused regulatory and compliance overlay, and mapping competing causal mechanisms. Using a continuous hypothetical deterioration case, the course demonstrates how these analytical lenses change litigation decisions.

Learning objectives

  • Distinguish a traditional medical chronology from a litigation-focused Clinical Intelligence analysis.
  • Evaluate record integrity, baseline trajectory, imaging context, and reconstructed decision windows.
  • Analyze role-specific standards of care and regulatory evidence without treating policies as automatic proof of liability.
  • Build and challenge a causal chain using mechanism, lost opportunity, clinical progression, outcome difference, and competing explanations.
  • Convert medical-record analysis into litigation-ready decisions concerning discovery, experts, depositions, leverage, and resolution.

Course 2

Applying the Lexcura Clinical Intelligence Model™ in Long-Term Care Litigation

1 General CLE

Long-term care litigation rarely turns on a single event, document, or timestamp. Relevant evidence is frequently distributed across assessments, care plans, medication records, treatment administration records, staffing documentation, electronic audit data, facility policies, hospital records, survey findings, and communications among multiple caregivers. This attorney education program explains how the Lexcura Clinical Intelligence Model™ can be applied to evaluate the clinical and operational evidence in nursing home and long-term care cases — connecting resident baseline, changes in condition, care obligations, notice, responsibility, intervention opportunities, system performance, competing causation, and probable outcome impact. The program addresses pressure injuries, falls, infection and sepsis, malnutrition and dehydration, medication-related injury, elopement, abuse, unexplained injury, transfer and discharge, hospice, and preventable decline.

Course 3

Reconstructing Sepsis Care from the Medical Record

1 General CLE

Sepsis litigation is rarely resolved by identifying one abnormal laboratory value, one missed timestamp, or one guideline reference. A defensible analysis requires counsel to determine what information was available, when it became actionable, what response was reasonable at that time, whether the required intervention actually reached the patient, and whether an earlier or different response probably would have changed the outcome. This attorney-focused course presents a structured method for reconstructing sepsis and septic shock care from fragmented medical records, distinguishing orders from administrations, documentation gaps from proven omissions, treatment opportunity from outcome probability, and quality-measure evidence from the legal standard of care.

Learning objectives

  • Differentiate infection, sepsis, septic shock, organ dysfunction, and failure-to-rescue issues while reconstructing the clinical timeline through parallel evidence tracks.
  • Evaluate whether an intervention was ordered, available, administered, monitored, and reassessed.
  • Apply guidelines, quality measures, policies, and regulatory materials appropriately while mapping causation through opportunity, mechanism, competing explanations, and probable outcome difference.

Course 4

The Missed Window

1.5 General CLE1.5 Civil Trial certification

The Missed Window is an advanced medical-legal program on diagnostic-delay and missed-diagnosis litigation. Attorneys learn to reconstruct the provider's contemporaneous information state, identify when clinical action became reasonably required, and determine whether a meaningful treatment opportunity remained. The course separates record fact from inference, breach from causation, and diagnostic delay from disease progression, and applies Florida medical-negligence principles to provider-specific duty, expert fit, presuit investigation, and proof that an alleged delay probably affected the outcome. Applications include stroke, pulmonary embolism, acute coronary syndrome, cancer, spinal compression, ectopic pregnancy, infection, appendicitis, radiology, pathology, emergency and outpatient care, telephone encounters, and telehealth.

Learning objectives

  • Reconstruct the diagnostic decision process from information available at the disputed time without hindsight.
  • Define a provider-specific breach theory and the precise earlier action it requires.
  • Test the intervention window through clinical actionability, operational feasibility, and time-specific treatment benefit.
  • Separate breach from causation and evaluate whether the delay probably changed a defined injury or outcome.
  • Develop focused discovery, deposition, and expert strategies for unsupported links in plaintiff and defense theories.

Course 5

When Complications Escalate

1.5 General CLE1.5 Health Law certification

When Complications Escalate is an advanced, practice-focused program teaching attorneys to analyze surgical-complication and postoperative failure-to-rescue cases using the Lexcura Clinical Intelligence Model™. The course distinguishes a known or unexpected complication from negligent technique, deficient surveillance, communication failure, delayed escalation, and causally significant rescue delay. It integrates provider-specific standard-of-care and causation principles with record-integrity analysis, postoperative trajectory reconstruction, the recognize-relay-react framework, operational feasibility, source-control timing, discovery, and expert sequencing. Applications include postoperative bleeding, anastomotic leak, perforation, infection and sepsis, respiratory failure, pulmonary embolism and DVT, cardiac and neurologic complications, wound failure, retained items, and ambulatory-surgery discharge.

Learning objectives

  • Distinguish a surgical complication from negligent operative technique, negligent postoperative management, and causally significant added harm.
  • Reconstruct preoperative, intraoperative, anesthesia, PACU, floor, escalation, and definitive-rescue evidence as one synchronized clinical journey.
  • Identify when postoperative findings cross from expected recovery or reasonable uncertainty into an actionable signal cluster.
  • Test recognize, relay, and react failures and whether communication reached a person with authority to act.
  • Define a condition-specific rescue window and sequence the qualified experts required to prove or challenge each link.

Course 6

Before the First Breath

1.5 General CLE1.5 Civil Trial certification

Before the First Breath teaches attorneys to analyze obstetric and birth injury matters as an integrated maternal-fetal-delivery-neonatal evidence problem. Using a synthetic induction case and the Lexcura Clinical Intelligence Model™, the course moves from record integrity and prenatal reserve through fetal monitoring, uterine activity, oxytocin, communication, operative opportunity, neonatal resuscitation, encephalopathy, cooling, imaging, placental pathology, alternative causes, and Florida causation. Designed for plaintiff and defense counsel, the program emphasizes provider-specific duties, expert fit, operational feasibility, probable outcome difference, and transparent uncertainty.

Learning objectives

  • Reconstruct maternal, fetal, delivery-team, and neonatal timelines separately before testing their convergence.
  • Identify when changing information created a provider-specific duty to reassess, intervene, communicate, or escalate.
  • Evaluate fetal heart rate patterns, uterine activity, oxytocin exposure, and fetal reserve without allowing one label to decide negligence.
  • Define the operational intervention window and test whether compliant care probably would have changed the defined injury under Florida law.
  • Use neonatal findings within their evidentiary limits and sequence experts according to the disputed link each is qualified to address.
